Tommy Hoppe is a brand owned and operated by Tommy Hoppe Limited Liability Company, a Georgia limited liability company (“Tommy Hoppe,” “we,” “us,” or “our”). These Terms of Service govern your use of TommyHoppe.com and any order placed through the site. By using the site or placing an order, you agree to these Terms and the policies linked from them.
1. Eligibility and acceptable use
You must be legally able to enter into a binding contract to place an order. You may use the site only for lawful purposes. You may not interfere with the site’s operation or security; misuse another person’s information; introduce malicious code; scrape or copy the site in violation of law; or use our content, products, or services to infringe the rights of others.
2. Artwork, editions, and product information
We make reasonable efforts to describe each work accurately, including its title, materials, dimensions, edition information, condition, and included documentation. Screen settings, lighting, and photography can affect how color and texture appear. Dimensions are approximate unless expressly stated otherwise. Any edition number, signature, certificate, or other provenance information included with a work forms part of that product’s description.
Product images and display settings are for presentation only and do not transfer any copyright or reproduction rights.
3. Orders and acceptance
Submitting an order is an offer to purchase. We may accept or decline an order, including because of availability, pricing or description errors, suspected fraud, delivery restrictions, or inability to verify payment. An automated order confirmation acknowledges receipt but does not guarantee acceptance. A contract of sale is formed when we confirm acceptance or ship the order, whichever occurs first.
If we cancel an order after payment, we will refund the amount charged to the original payment method. Because works and editions may be limited, placing an item in a cart does not reserve it.
4. Prices, taxes, and payment
Prices are shown in the currency displayed at checkout and may change before an order is placed. Applicable taxes, delivery charges, duties, or other fees are shown at checkout when collected by us. International customers remain responsible for import duties, taxes, and brokerage fees not collected at checkout. Payment is processed by Shopify and its payment providers, and you agree to provide accurate billing and account information.
5. Shipping, delivery, and risk
Delivery options, destination limits, damage-reporting requirements, and international charges are described in our Shipping Policy, which is incorporated into these Terms. Delivery dates are estimates unless we expressly agree otherwise. Title and risk of loss pass to you upon delivery, except where applicable law requires a different result.
6. Returns and refunds
Returns, damage claims, non-returnable items, and refunds are governed by our Refund Policy, which is incorporated into these Terms. Nothing in these Terms limits any non-waivable consumer right.
7. Intellectual property
The site and its contents—including artwork images, photographs, text, graphics, logos, video, audio, and site design—are owned by or licensed to Tommy Hoppe Limited Liability Company and are protected by intellectual-property laws. Purchasing a physical work transfers ownership of that physical object only. Copyright and all reproduction, adaptation, distribution, display, merchandising, and other intellectual-property rights remain with their owner unless a separate written agreement expressly states otherwise.
You may view the site for personal, non-commercial use. You may not reproduce, publish, sell, license, train a model on, create derivative works from, or otherwise exploit site content without prior written permission, except as allowed by law.
8. Third-party services and links
Shopify and other third parties provide parts of the store, payment, fulfillment, delivery, and site functionality. Third-party services are governed by their own terms and privacy practices. Links to third-party sites are provided for convenience and do not imply endorsement.
9. Privacy
Our collection and use of personal information are described in our Privacy Policy.
10. Disclaimer
To the fullest extent permitted by law, the site and its general informational content are provided “as is” and “as available.” We do not promise that the site will always be uninterrupted, error-free, or free of harmful components. Any express product description and any rights that cannot lawfully be excluded remain unaffected.
11. Limitation of liability
To the fullest extent permitted by law, Tommy Hoppe Limited Liability Company and its owners, officers, employees, contractors, and agents will not be liable for indirect, incidental, special, punitive, or consequential damages, or for lost profits, revenue, data, or business opportunity, arising from the site or an order. Our aggregate liability relating to a product or order will not exceed the amount you paid for that product or order. These limitations do not apply where liability cannot lawfully be limited, including for fraud, willful misconduct, or other non-waivable rights.
12. Indemnity
To the extent permitted by law, you agree to indemnify and hold Tommy Hoppe Limited Liability Company harmless from third-party claims, damages, and reasonable costs arising from your unlawful use of the site, your violation of these Terms, or your infringement of another person’s rights.
13. Events outside our control
We are not responsible for delay or failure caused by events beyond our reasonable control, including carrier disruption, natural disaster, government action, labor dispute, utility or network failure, or civil emergency. We will make reasonable efforts to notify affected customers and complete or refund impacted orders as appropriate.
14. Governing law and disputes
These Terms are governed by the laws of the State of Georgia, without regard to conflict-of-law principles. Subject to any mandatory consumer protections that apply where you live, disputes will be brought in the state or federal courts located in Fulton County, Georgia. Before filing a claim, please contact us so we can try to resolve the matter informally.
15. Severability; waiver; assignment
If a provision is found unenforceable, the remaining provisions remain in effect and the affected provision will be enforced to the maximum extent permitted. A failure to enforce a provision is not a waiver. You may not assign your rights under these Terms without our consent; we may assign ours in connection with a reorganization, financing, merger, or sale of the business.
16. Changes
We may update these Terms by posting a revised version with a new “Last updated” date. Changes apply prospectively unless law requires otherwise. The Terms in effect when you place an order govern that order.
